Because developers would desperately like to control the distribution of their own games. Since they still depend on retailers as long as people still want the games on disc, however, the most they can do is make sure that the shops don't make any money selling their games.
With Microsoft's method of limiting second hand games, they can still allow the bigger retailers to sell used Xbox One games so they don't piss them off.
